NORTH CAROLINA
DUPLIN COUNTY
I, HENRY MOORE MIDDLETON, SR., a resident of, and domiciled in the County and State aforesaid, being of sound mind and disposing memory, but considering the uncertainty of my earthly existence, do make and declare this to be me [sic] last will, hereby revoking and declaring all other wills and codicils heretofore made by me null and void, and do make publish and declare this my last will and testament in manner and form as follows:
ITEM ONE
I direct my Executor hereinafter named to pay all of my just debts and funeral expenses, and to erect at my grave a suitable marker, and it is my desire that I be placed by the side of my first wife in the Warsaw Cemetary [sic].
ITEM TWO
Subject to the specific bequests hereinafter provided, I will, devise and bequeath all of my property of every sort, kind and description, both real and personal, to my wife, Rosa Middleton, for and during the term of her natural life. It is my fervent desire that my four children shall fully understand and appreciate my reasons for the provisions contained in this item of this my last will and testament and to that end I desire to incorporate herein the following by way of explanation of the provision. Since my marriage to my present wife, Rosa, in the year 1951, she has been a devoted, dutiful and faithful wife and a loyal companion. she has given her constant attention to my every desire and need, in time of sickness and in health, and in consideration of the above, it is my will and desire and I make this provision for her as contained in this item to the end that she will be secure for the remainder of her life. It is my further desire that my children should understand that the provision contained herein is not made for any want or lack of love and affection for them, but to the contrary, I simply desire to postpone their enjoyment of my estate in order to provide security for my beloved .wife.
ITEM THREE
I will, devise and bequeath unto my children, Helen G. Piner, Katie Mae Bell, Henry Moore Middleton, Jr., and George W. Middleton, a vested remainder in fee simple in and to all of my property of every sort, kind and description, both real and personal, subject to the life estate of my said wife as set out in the preceding item.
ITEM FOUR
I will, and bequeath to my daughter, Helen G. Piner, all of the furniture in her mother's bedroom and I direct my Executor, hereinafter named, to deliver up possession of said furniture to my daughter, Helen G. Piner, upon my demise.
ITEM FIVE
I have heretofore given to my daughter, Katie Mae Bell, her mother's best set of chine [sic], and this shall constitute her portion of my estate pending of my wife, when she shall then share equally in the remainder.
ITEM SIX
I will and bequeath to my son, Henry Moore Middleton, Jr.., all the tools and machinery in the shop, all of the front porch furniture, and also the mirror over the mantel in the living room, and I direct my Executor, hereinafter named, to deliver up possession of the above items to my son, Henry Moore Middleton, Jr., upon my demise.
ITEM SEVEN
I will and bequeath to my son, George W. Middleton, the desk he made for his mother and also my five horse power electric motor that is used for sawing wood.
ITEM EIGHT
I hereby constitute and appoint my son, George W. Middleton, the Executor of this my last will and testament.
IN TESTIMONY WHEREOF, I, The said HENRY MOORE MIDDLETON, SR., have hereunto set my hand and seal, this 19th day of July, 1957.

Signed, sealed, and published and declared by the said Henry Moore Middleton, Sr., to be his last will and testament, in the presence of us, who at his request and in his presence and in the presence of each other, do hereto set out [sic] names as witnesses.
